The company DOCANTIC.Inc is located at 906 N La Cienega Boulevard Suite #2, Los Angeles 90069 CA, USA.
DOCANTIC.COM is an Internet service provided by DOCANTIC and made available under the terms and conditions of this user contract.
This User Contract alone is the only document contractually linking you, as a user of DOCANTIC’s services, with DOCANTIC.
By accessing the DOCANTIC.COM website, whatever the Internet address or URL used and/or by buying response units, taking out a subscription and/or registering on the DOCANTIC website you accept to be bound by all the terms of this User Contract.
In any dispute, the English version of DOCANTIC’s User Contract is the only possible reference.
ARTICLE 1: USER INFORMATION
DOCANTIC is authorized to ask you for personal information on your identity and your bank details to facilitate the management of your account and improve its services.
DOCANTIC.COM reserves the right to refuse the registration or subscription of a client with whom it has had past payment difficulties or who has demonstrated a lack of respect for DOCANTIC’s User Contract or existing laws and regulations.
For responsive design issues, an account has to be created from a laptop or desktop; some features / text might not be showcased from tablets or smartphones.
ARTICLE 2: USE OF THE DOCANTIC.COM WEBSITE
From the DOCANTIC.COM website, you can consult the entirety of the databanks available on the website.
To open an account, a valid name and last name must be provided. A company name cannot be provided to open an account; if so, the company name shall be replaced by the company's owner's name.
Our website requires cookies to be enabled in your web browser to maintain your session with the web server.
DOCANTIC reserves the right to limit the number and frequency of consultations effected on its website and any such reduction or limitation shall under no circumstances be considered grounds for any claim or to have occasioned any prejudice to the user.
We prohibit any consultations that do not conform to the profession’s customs, any automated consultations, especially those generated by a machine, software or hardware system, and any consultations based on algorithms, mathematical series or by comparison with another existing databank.
ARTICLE 3: USER DECLARATION
The user states that he/she is at least 18 years of age and has the legal competence to conclude this contract, register on DOCANTIC’s website to buy the units and/or take out a subscription allowing him/her to subsequently make consultations.
By using the username and password sent by DOCANTIC to the user, the user accepts sole responsibility for consulting DOCANTIC’s databanks.
DOCANTIC shall attempt to satisfy all such consultations, it being understood that DOCANTIC’s obligation is limited to that of due care and diligence.
DOCANTIC cannot be held responsible for the fraudulent use of the username and password of the user which are the only references that DOCANTIC is authorized to verify.
DOCANTIC cannot be held responsible for any existing mistake within the database (mismatching artist-picture, picture-page, page-book, etc.). The database is filled manually and errors may occur.
ARTICLE 4: SITE CONTENT
DOCANTIC.COM makes available online databanks containing information about art, the art market and art documentation.
In order to do so, DOCANTIC processes raw information and incorporates it into its databanks manually.
DOCANTIC offers no guarantee as to the absolute accuracy of the information concerned (name of the artist, date of creation, book reference, information provided in the news section). It commits itself only to an obligation of due care and diligence in processing the information it collects.
The client is asked to inform DOCANTIC of any broadcasted misinformation through the contact form.
DOCANTIC offers two packages to access its database: DAY and MONTH. The DAY package is valid for 24 hours and is limited to a viewing of 10 product pages per 24 hours. The DAY package will be automatically suspended as soon as the 10 products pages per 24 hours views limit is reached. The MONTH package is valid for 30 days and is unlimited, yet, restricted to a normal usage.
To avoid manual and/or automatic crawling, DOCANTIC will suspend any client’s account if he/she does not have a normal use of the database. DOCANTIC will close any account suspended at least 2 times for crawling behavor. The account holder shall not be refund.
ARTICLE 5: PROPERTY
All programs, services, procedures, concepts, non-commercial software, brands, technological elements and content of the databanks as well as all the services offered by DOCANTIC remain the full and exclusive property of DOCANTIC and are protected by intellectual copyright.
Any unauthorized use of DOCANTIC’s protected services, procedures, concepts, non-commercial software, brands, technological elements or databank content is strictly prohibited.
Thus any use of pictures or data contained in the current database must be previously authorized by DOCANTIC.COM, and if distributed to the public, must respect the moral rights of DOCANTIC and indicate the following: 'source: DOCANTIC.COM'.
ARTICLE 6: ABSENCE OF GUARANTEE AND LIMITATION OF RESPONSIBILITIES
All information in the DOCANTIC.COM databanks is provided ‘as seen’ and DOCANTIC offers no express or implied guarantee as to the content of this information which has been collected and collated from other pre-existing elements which may themselves contain errors. DOCANTIC encourages his clients to always double-check an attribution by downloading/ordering the original documentation source.
DOCANTIC, while seeking to minimize these errors, nevertheless accepts no responsibility for the presence of any erroneous information on its databanks. By this contract, the user renounces any claim or right to engage in litigation relative to any loss or injury caused by any such errors on the basis of contractual or criminal responsibility, or on any other basis.
Furthermore, if the client has a doubt on an attribution seen on DOCANTIC.COM, he/she is asked to immediately report it through the dedicated link located under each single main picture of a product page (exclamation point logo).
ARTICLE 7: PAYMENT
When opening his/her account to access payable services, the user shall choose the type of membership package he/she wishes to purchase. Each membership package has a specific limit of validity and includes different amounts of credits.
Extra credits packages can be purchased within DOCANTIC. These credits allow you to purchase PDF versions of pages, PDF versions of books and/or printed versions of books.
These credits have a validity time limit of 1 year (365 days) but can be spent only with an active account. Credits of an expired account are not lost; and will be added to the linked account if activated again in the 1 year period.
Each bought information (PDF format page, PDF format book, Paper format book) contained in the databanks will trigger a deduction in the number of credits, which are appearing in client’s account area of the website. Unlimited access subscribers can access the databases depending on the subscription option and must abide by Article 2 above.
Please note that, when ordering on our website, prices are shown in US Dollars for all countries. All transactions are handled in US Dollars. Prices might be shown in other currencies. The prices other than US Dollars are shown for reference only.
DOCANTIC is not responsible for any difference that may arise between the estimated amount of your order and the invoiced amount, due to changing currency rates and bank fees.
In the event of online or deferred payments by the client being rejected, DOCANTIC reserves the right to suspend or cancel without prior warning the registration of the user and to bill the client for any costs related to such rejected payments.
The MONTH package is on automatic renewal. You'll be charged on day one and again every 30 days. You can cancel the automatic renewal at any time by sending a registered letter with an acknowledgement of receipt at DOCANTIC's headquarters or by managing your automatic renewals through your Paypal account. ARTICLE 8: TRANSFER - USE
The account is strictly for the personal use of the user alone. DOCANTIC does not allow multisession from several devices with the same account.
The user is therefore forbidden to cede, transfer or sublicense his/her rights as a user to anyone whatsoever. The user is also forbidden to share or sell downloaded information and/or screenshots from DOCANTIC.COM with a third party.
He may not allow other persons to use his/her account, password and username.
If the general conditions of use herein are infringed, the user's subscription and/or registration may be cancelled immediately by DOCANTIC.COM, in which case the subscription will not be refunded and the user may claim no indemnity from DOCANTIC.COM. Furthermore, DOCANTIC.COM reserves the right to claim from fraudulent users the payment of any sum unduly paid as a result of the fraudulent use of their account by any other user and/or the infringement of the general conditions of use herein.
It is strictly forbidden to login to DOCANTIC on two (2) or more devices at the same time. DOCANTIC will be notified for such misusage and shall take appropriate actions against the offender.
Accounts cannot be closed by the user. To close an account, the user needs to send his/her request to DOCANTIC's team at clients@docantic.com.
ARTICLE 9: COPYRIGHTS
Due to the fact that the search for possible copyrights relating to some of the photographs and their subjects that are accessible on this site is materially limited for reasons of age, disappearance or the anonymity of the sources, we respect the decision of copyright holders who do not wish to publish such photographs.
ARTICLE 10: APPLICATION DATE OF CONTRACT
This contract shall come into effect on the date it is first accepted, and remain in force until the closure of the account.
DOCANTIC reserves the right to modify this contract at any moment by posting the modifications online and it is the client’s responsibility to regularly acquaint him/herself with the user information that shall be made available online for this purpose.
If the client continues to use the DOCANTIC.COM website after the online posting of any such modifications he/she shall be deemed to have accepted the present contract along with its modifications.
If a client disagrees with any modifications, he/she shall inform DOCANTIC within a period not exceeding 30 days of their initial publication by DOCANTIC.
ARTICLE 11: LEGAL JURISDICTION
This contract is subject to Californian (USA) law.
The client and DOCANTIC accept the competence of the courts of Los Angeles (CA) to rule on any litigation relating to the termination or cancellation of this contract.
ARTICLE 1: SCOPE OF APPLICATION
The User Contract applies exclusively to commercial relations between DOCANTIC.Inc is located at 906 N La Cienega Boulevard, Los Angeles 90069 CA, USA, and you, the DOCANTIC Advertisement customer.
DOCANTIC.COM reserves the right to modify this User Contract at any time. However, only the User Contract applicable at the time an order is made shall govern the contractual relations between DOCANTIC.COM and the customer ensuing from the placement of an order.
ARTICLE 2: POSTING OF ADVERTISEMENT
DOCANTIC.COM accepts your Advertisement providing that it complies with the terms of this User Contract. By confirming the placement of your Advertisement with DOCANTIC electronically or by any other means, you accept all the terms and conditions enumerated herein.
ARTICLE 3: DOCANTIC ADVERTISEMENTS
DOCANTIC.COM cannot be liable for the quality of reproduction of the images you choose to post in your Advertisements.
Vendors are solely responsible for any data and information posted in an DOCANTIC Advertisement. The publication by DOCANTIC.COM of an Advertisement cannot under any circumstances be interpreted as constituting a guarantee or endorsement by DOCANTIC of the authenticity or origin of the object or item being offered for sale. DOCANTIC reserves the right to remove from its standardized marketplace any advertisement and / or material of any kind that violates applicable law, public order or common decency or that violates these General Conditions of its editorial policy, either at the request of a judicial authority or on its own initiative. DOCANTIC reserves the right to refuse service to any person who has presented or who presents false, suspect or misleading information, or with history of insolvency or behavior contrary to the law, a breach of public order or morality, or has not respected or has broken current terms of use.
DOCANTIC Advertisements must not contain viruses, worms or other computer program intended to damage or to surreptitiously intercept any IT system, database or personal information.
In addition, you may not place any advertisement that would violate applicable law, public order or common decency, or that violates the rights or licenses of third parties, copyright laws, industrial and / or intellectual property rights or that violates this User Contract.
DOCANTIC.COM reserves the right to remove any Advertisement and/ or any element which would be contrary to law, public policy or public decency, or which would contravene this User Contract or DOCANTIC's editorial policy.
If DOCANTIC.COM decides to withdraw your advertisement for reasons relating to the violation of this User Contract, your advertisement will not be refunded and you may not claim any compensation from DOCANTIC.COM.
ARTICLE 4: USAGE AUTHORISATION
In order to allow DOCANTIC.COM to use the elements (information, text, images, photos) included in your Advertisement without violating any rights that you may possess in respect of these items, you grant DOCANTIC.COM, by accepting the terms of this User Contract, a non-exclusive, free, geographically and temporally unlimited right, to use, exploit and publish the said elements on any paper or digital support, and to sub-authorize any third party to do likewise, in accordance with DOCANTIC.COM’s Confidentiality Charter. This authorization shall remain in force throughout the legal protection period of your personal information.
You agree not to use software or any manual process to copy DOCANTIC.COM’s web pages or to save or collect information on these pages without the express prior written permission of DOCANTIC.COM. You agree not to use any devices or software of any kind to interfere or attempt to interfere with the proper functioning of DOCANTIC.COM’s website. You agree not to undertake any action which would impose a disproportionate burden on our infrastructures. You agree not to copy, reproduce, alter, modify, create derived works or disclose all or part of the content of our website to the public without our prior express written consent or the consent of any relevant third parties.
DOCANTIC.COM cannot be held responsible if all or part of the contents of a DOCANTIC Advertisement is reproduced on other websites or any other existing or future media without its knowledge and its written consent.
ARTICLE 5: COMPENSATION
You agree to indemnify DOCANTIC and the other companies in the DOCANTIC Group and its corporate officers, directors and employees against any claim by any third party (ies) caused by or resulting from your breach of these general conditions or a your breach of any statutory provision or of any rights possessed by the said third party (ies). This guarantee shall cover both the principle of any potential damages awarded and any litigation costs incurred.
ARTICLE 6: LIABILITY
The publication by DOCANTIC.COM of an Advertisement cannot under any circumstances be interpreted as constituting a guarantee or endorsement by DOCANTIC.COM of the authenticity or origin of the object or item being offered for sale in one of the categories Art, Antiques and Design.
DOCANTIC.COM, on the one hand, and you, on the other, are independent parties, with each party acting in its own name and on its own behalf. We do not intercede in transactions between buyers and sellers. Accordingly, we do not exercise any control over the quality, security or lawfulness of the items which are listed, the truth or accuracy of the contents of DOCANTIC Advertisements posted online, the sellers’ legal capacity to sell said items or services, or the buyers’ ability to pay for said items or services.
You therefore discharge DOCANTIC (as well as its subsidiaries, associated companies, managers, senior executives and employees) from all liability in event of a dispute or claim, and from liability for all present or future damage resulting directly or indirectly from your DOCANTIC Advertisement.
This DOCANTIC Advertisement User Contract does not create any tied link, mandate, jointly-owned company, joint venture, franchiser / franchisee or employer / employee relations between DOCANTIC and you the user. We cannot be liable for the content of websites towards which you may be directed by hypertextual links on our website. DOCANTIC.COM undertakes to take all due care commonly practiced in the profession to implement the service(s) proposed to its customers. However, we cannot be liable for breaches of our contractual obligations resulting from a fortuitous events or a force majeure event such as (without being limited to), disasters, acts of terrorism, sabotage, strikes, fire, flood, material failure or breakdown of means of transportation, means of communication, or on account of any action initiated by the customer.
In addition, we cannot be liable for errors in the presentation of products on our website, as the photographs, texts and illustrations representing the products are not contractual.
ARTICLE 7: PROTECTION OF PERSONAL DATA
All personal data pertaining to you is handled with the utmost confidentiality, in accordance with the provisions of DOCANTIC.COM’s personal data protection policy.
At the time of your purchases, we only ask you for information that is absolutely essential in order to ensure the quality of the services and processing of your order. When creating your DOCANTIC account you must fill in the registration form with accurate information and update it when necessary. At the time of publication of your DOCANTIC Advertisement, only users of the DOCANTIC.COM website who have registered beforehand will be able to visualize the data that enables them to contact you.
By accepting this User Contract, you acknowledge that you have read our personal data protection policy and you grant us the right to collect and use this data.
ARTICLE 8: APPLICABLE LAW AND COURT OF COMPETENT JURISDICTION
This User Contract is subject to Californian (USA) law. Disputes relative to trade relations between DOCANTIC and its customer are subject to the exclusive competence of the Los Angeles (CA) courts.

ARTICLE 5: DELIVERY
The PDF version of pages or PDF version of books may take up to 2 business days. Those can be delivered either by attached files in email(s), or by link by email.
The items ordered shall be delivered to the address given in the order, unless other specific information is provided. All transport risks shall be borne pass by the customer after the products are shipped out of the DOCANTIC premises. The delivery schedule is given as a rough guide.
ARTICLE 6: RETURNS
Returns are not applicable for PDF version of pages or books.
The customer has until 14 (fourteen) days after receipt of goods to withdraw from the purchase, by sending a withdrawal form to the sender.
Return shall be at the customer’s expense unless the items are returned because of a mistake on our part. We will only refund or exchange the books returned complete, in their sent condition and in their original packaging. You must also include the invoice reference, the customer’s details as well as the reason for the exchange or refund.

At the end of the 14 (fourteen) day cooling off period, the delivered items shall be considered as conforming to the order and as accepted by the customer.
ARTICLE 7: SELL YOUR DOCUMENTATION
You may submit your documentation to DOCANTIC for sale or lease. The leasing period, sale price or lease price will be negotiated between you and DOCANTIC by written notice (fax, email or mail).
You declare having all rights on the sold/leased documentation.
Documentation has to be sent to the address in Article 6.
DOCANTIC will pay for the purchased book(s) once all have been received by DOCANTIC. Delivery fees (and return fees for leasing option) will be borne by DOCANTIC.
ARTICLE 8: PROPERTY RESERVES
The delivered items shall remain DOCANTIC’s property until all your obligations to DOCANTIC are fulfilled. The present property reserve does not obstruct the transfer of liability for the transport risks to the customer as soon as the ordered products are shipped out of the DOCANTIC premises, in accordance with Article 5 above.
ARTICLE 9: LIABILITY
DOCANTIC cannot be held liable for the content of websites to which the customer may be directed from our website via hypertext links.
We undertake to take all the necessary care and measures to ensure as good a service as may be expected on the market. However, we cannot be held liable for any failure to meet the contractual obligations when any such failure is the direct or indirect result of an accident or force majeure such as natural catastrophe, strike, fire, arson, flooding, faulty or broken down equipment, transportation and communication means or of any decision taken by the customer.
Moreover, DOCANTIC cannot be held liable for any differences in the products received and their presentation on our website. DOCANTIC does not guarantee that the photographs, texts and illustrations presenting the products are accurate and error-free.
ARTICLE 10: PRIVACY POLICY
All personal information is handled with the highest level of confidentiality and in accordance with the provisions of our personal data protection policy.
When buying from the DOCANTIC bookshop, we only ask you to provide the minimum required information for us to ensure quality services and processing. This minimum information may be shared with our partners, suppliers, service providers or affiliates.

The client may submit to DOCANTIC artworks for identification. These submissions will be shared with DOCANTIC community through the media(s) of DOCANTIC's choice.

ARTICLE 2: SUBMISSION PROCESS
We accept your submission according to the present User Contract.
You agree to send only submissions that match the DOCANTIC categories (20th Century furniture and/or lamps and/or rugs and/or works of art).
You declare holding all copyrights for the submitted pictures and/or have permission to post these pictures on DOCANTIC.COM.
When confirming your submission you accept the entire User Contract hereby presented and available at any time on the website. You also acknowledge having read, understood and accepted the User Contract.
We prohibit any submission that do not conform to the profession’s customs and any automated submission, especially those generated by machines, programs, IT installations or any algorithmic survey systems, mathematical series or differentials with existing databanks.
Each submission will be reviewed by DOCANTIC within two (2) business days. If accepted, the submission will be available on DOCANTIC.COM and on social medias (Facebook, Twitter, LinkedIn, Instagram, etc.).
The submission service cannot be used as an advertising tool. Any signature, name, reference to a business, etc. will be removed by DOCANTIC before being posted online. Additional fees could apply.
ARTICLE 3: PRICE
A fixe fee is applicable to the submission services.

ARTICLE 4: PAYMENT AND REFUNDS
You will be asked to pay the submission fee for each submission.
Anyone providing an acceptable proof of identification will get all of the reward offered by the submitter within 5 business days.
If no acceptable proof is provided in the 90 days window following the submission, and if the client asks for a refund by email, he/she will get a refund either by transfer, Paypal, or by being given a 3-DAYs access to DOCANTIC's database. If the client does not contact DOCANTIC within 48 hours before the 90 days deadline, the submission will be broadcasted for another 90 days, free of charge. If no acceptable proof is provided in the second 90 days window, the client will be able to ask for a refund of the $100, either by transfer, Paypal, or by being given a 3-DAYs access to DOCANTIC's database. If the client does not contact DOCANTIC within 48 hours after the second 90 days window, the client won't be able to ask for the refund of the $100. All transfers fees, currency changes and bank commissions will be borne by the client.
ARTICLE 5: ACCEPTABLE PROOF SUBMISSION
The proof submitter declares that the provided proof is genuine and hasn’t been digitally edited. To be approved by DOCANTIC the proof of evidence has to be from a paper support, enclose at least one picture, the name of the artist and the source from which the picture was taken from. An auction catalogue and/or a website screenshot will not be treated as an acceptable proof. Any book/ad/catalog edited after the death of the artist might not be treated as an acceptable proof.
ARTICLE 6: STATUS TAG
If accepted by the DOCANTIC team, a submission will be broadcasted on DOCANTIC.COM with a "WHO?" tag. At this point, the submission is active and any visitor is able to submite an identification proof. As soon as an identification proof is sent, the broadcasted submission will be tagged as "HOLD". At this point no one is able to submite another proof. Unless the 90 days are over, if the proof is rejected, the submission will come back to its "WHO?" status. If the proof is accepted, the broadcasted submission will be tagged as "FOUND". If no acceptable proof was submited to DOCANTIC in the 90 days window, the submission will automaticaly be removed from DOCANTIC.COM.
ARTICLE 7: LIABILITY
DOCANTIC cannot held to an obligation of result.
We undertake to take all the necessary care and measures to ensure as good a service as may be expected on the market. However, we cannot be held liable for any failure to meet the contractual.
Moreover, DOCANTIC does not guarantee that the photographs, texts and illustrations presenting the products, nore the prooves submited by the community are accurate and error-free.
